27 AVRIL 2012. - Arrêté du Gouvernement flamand portant classement du cours d'eau non classé « Puttengracht » et d'un fossé de jonction comme cours d'eau non navigables de deuxième catégorie à Opwijk
Le Gouvernement flamand,
Vu la loi du 28 décembre 1967 relative aux cours d'eau non navigables, notamment l'article 4;
Vu la demande de la députation du Brabant flamand de classer le « Puttengracht » et le fossé de jonction, situé entre le « Puttenbeek » classé comme deuxième catégorie et le « Puttengracht », également dans la deuxième catégorie;
Considérant que le bassin du « Puttengracht » n'excède cependant pas 100 ha;
Considérant que l'article 4 de la loi relative aux cours d'eau non navigables prévoit la possibilité de classer pour des raisons d'utilité publique les cours d'eau dont le bassin n'excède pas 100 ha comme cours d'eau non navigables;
Considérant que la province vise à optimaliser la gestion des eaux dans la région par la rétention des eaux dans les secteurs « Rietveld », « Mansteen » et « Langeveldweg »; que la province est l'initiatrice de l'aménagement de ces zones inondables contrôlées; que deux des trois secteurs se situent le long de cours d'eau de deuxième catégorie, tandis que le secteur « Rietveld » est situé le long du « Puttengracht » non classé; que la province veut gérer plus efficacement les différents ouvrages d'art et les cours d'eau concernés dans la région; que malgré l'aménagement de zones inondables contrôlées dans le bassin hydrographique du « Stambeek » et du « Puttenbeek », le « Puttengracht » et le fossé de jonction continuent à recevoir une partie du débit du « Puttenbeek », propulsant l'eau du « Puttengracht »; qu'un ouvrage d'art de répartition est en outre installé sur le « Puttengracht », à la hauteur du secteur « Rietveld »; qu'il est indiqué et justifié de classer également les cours d'eau non classés « Puttengracht » et le fossé de jonction dans la deuxième catégorie;
