13 JUIN 2002. - Arrêté du Gouvernement de la Communauté française déterminant les modalités applicables pour la modification du cadastre des fréquences attribuables visé à l'article 2 du décret du 20 décembre 2001, fixant le cadastre initial de référence de la Communauté française pour la radiodiffusion sonore en modulation de fréquence dans la bande 87.5-108 MHz et modifiant le décret du 24 juillet 1997 relatif au Conseil supérieur de l'Audiovisuel et aux services privés de radiodiffusion sonore
Le Gouvernement de la Communauté française,
Vu le décret du 20 décembre 2001, fixant le cadastre initial de référence de la Communauté française pour la radiodiffusion sonore en modulation de fréquence dans la bande 87.5-108 MHz et modifiant le décret du 24 juillet 1997 relatif au Conseil supérieur de l'audiovisuel et aux services privés de radiodiffusion sonore de la Communauté française, et en particulier son article 2;
Considérant que, pour chaque fréquence attribuable, les coordonnées géographiques du site d'émission, la hauteur d'antenne, la puissance apparente rayonnée et les atténuations directionnelles éventuelles sont déterminées par le Gouvernement, sur avis conforme du Collège d'Autorisation et de Contrôle du Conseil supérieur de l'Audiovisuel, lors de la publication de l'appel d'offres visé à l'article 38 du décret du 24 juillet 1997, relatif au Conseil supérieur de l'audiovisuel et aux services privés de radiodiffusion sonore de la Communauté française;
Considérant que l'article 36 du même décret précise que le Gouvernement arrête la liste des réseaux de fréquences et des fréquences attribuables, sur avis conforme du Collège d'Autorisation et de Contrôle du Conseil supérieur de l'Audiovisuel;
Considérant la nécessité d'offrir aux opérateurs un cadastre de fréquences garantissant une diversité des projets radiophoniques et un confort d'écoute suffisant;
Considérant l'intérêt qu'il y a de préserver le patrimoine des fréquences de la Communauté française;
Vu l'avis du Conseil d'Etat du 15 mai 2002;
