27 AVRIL 2006. - Arrêté du Gouvernement de la Région de Bruxelles-Capitale relatif à l'expropriation des terrains situés sur le territoire de la Commune de Koekelberg pour le réaménagement de la place des Etangs noirs
Le Gouvernement de la Région de Bruxelles-Capitale;
Vu la loi spéciale de réformes institutionnelles du 8 août 1980, modifiée par les lois du 8 août 1988, du 5 mai 1993. et du 16 juillet 1993, notamment les articles 6 § 1er, X, 1 et 79;
Vu la loi spéciale du 12 janvier 1989 relative aux Institutions bruxelloises, notamment l'article 38;
Vu l'ordonnance de la Région de Bruxelles-Capitale du 22 février 1990 relative aux expropriations pour cause d'utilité publique poursuivies ou autorisées par l'Exécutif de la Région de Bruxelles-Capitale;
Vu la loi du 26 juillet 1962 relative à la procédure d'extrême urgence en matière d'expropriation pour cause d'utilité publique;
Vu le Plan régional des Déplacements approuvé par le Gouvernement de la Région de Bruxelles-Capitale le 1er octobre 1998;
Considérant le projet de réaménagement élaboré par le Service public fédéral mobilité et transports tendant à créer des trajets sécurisés pour piétons et personnes malvoyantes et à remédier aux problèmes de circulation des transports publics et des véhicules automobiles sur la place des Etangs noirs;
Vu la nécessité de réaliser ces améliorations dans les plus brefs délais, étant donné les problèmes croissants de mobilité en Région de Bruxelles-Capitale;
Vu l'accord de coopération du 15 août 1993 entre l'Etat fédéral et la Région de Bruxelles-Capitale, avenant numéro 8, chapitre VII - Quartiers en difficultés - Noyaux commerciaux - Molenbeek - Koekelberg - Chaussée de Gand;
Vu la décision du Gouvernement du 6 novembre 2003. approuvant le dossier de demande de permis d'urbanisme relatif au projet de réaménagement élaboré par le Service public fédéral mobilité et transports, visant le noyau commercial de la chaussée de Gand;
Sur la proposition du Ministre des Travaux publics et de la Mobilité,
Arrête :
Article 1er. Le présent arrêté règle une matière visée à l'article 39 de la Constitution.
