Le Gouvernement flamand,
Vu le décret du 27 mars 2009 relatif à la politique foncière et immobilière, notamment l'article 2.2.9, 4° à 6°;
Vu l'arrêté du Gouvernement flamand du 10 juillet 2009 relatif aux modalités du registre des immeubles inoccupés et modifiant l'arrêté du Gouvernement flamand du 2 avril 1996 portant la redevance visant à lutter contre l'inoccupation et le délabrement de bâtiments et/ou d'habitations;
Vu l'accord du Ministre chargé du Budget, donné le 7 mars 2013;
Vu l'avis 53.028/3 du Conseil d'Etat, donné le 8 avril 2013, en application de l'article 84, § 1er, alinéa premier, 1°, des lois sur le Conseil d'Etat, coordonnées le 12 janvier 1973;
Sur la proposition de la Ministre flamande de l'Energie, du Logement, des Villes et de l'Economie sociale;
Après délibération,
Arrête :
Article 1er. L'intitulé du chapitre 1er de l'arrêté du Gouvernement flamand du 10 juillet 2009 relatif aux modalités du registre des immeubles inoccupés et modifiant l'arrêté du Gouvernement flamand du 2 avril 1996 portant la redevance visant à lutter contre l'inoccupation et le délabrement de bâtiments et/ou d'habitations est remplacé par ce qui suit :
Chapitre 1er. - Dispositions générales

Art. 2. Dans l'article 1er du même arrêté, le point 3° est remplacé par ce qui suit :
3° instance de recours :
a) le collège des bourgmestre et échevins ou le membre du personnel délégué, visé à l'article 2.2.7, § 5, du décret;
b) l'organe de décision de l'unité administrative intercommunale à individualité juridique, visé à l'article 2.2.6, § 1er, alinéa deux, du décret;
