Le 31 mai 2002, la Cour d'appel de Bruxelles a tranché en faveur de l'administration fiscale un litige relatif à la déductibilité, à titre de frais professionnel, du montant à concurrence duquel l'actionnaire d'une société avait pris en charge la perte de cette dernière.
En l'espèce, le contribuable détenait 90 % des parts d'une SPRL, dotée d'un capital de 1.500.000 BEF (37.184,03 Eu.), dans laquelle il avait le statut, au terme du relevé 204 S, d'associé non actif. Dans le même sens, le fisc relevait que le contribuable n'avait jamais perçu de revenus professionnels de la part de la SPRL dont l'activité consistait en la gestion de biens immobiliers. Elle était ainsi propriétaire de bâtiments évalués à 8.850.259 BEF (219.392,19 Eu.). La SPRL avait toutefois contracté une dette, dont le créancier était le contribuable associé non actif pour un montant de 7.245.646 BEF (179.614,87 Eu.). Durant l'année 1986, le contribuable avait réduit le montant de sa créance sur la SPRL à concurrence d'un montant équivalent à 90 % de la perte de l'exercice social clôturé le 31 décembre 1986. En sa qualité de personne physique, il avait alors porté un montant de 4.043.637 BEF (100.239,14 Eu.) en déduction de sa base imposable au titre de frais professionnel.
Une condition essentielle de l'admissibilité fiscale d'un frais professionnel consiste en ce que la dépense ou la charge a été supportée pour acquérir ou conserver des revenus professionnels.
Or, la Cour a constaté qu'en l'occurrence la réduction de la créance n'avait pas été faite dans cette optique dès lors que le contribuable ne recueillait quoi...
