Droits de succession: quid en cas de représentation par les neveux et nièces du défunt?

Lorsqu’un résident belge décède, ses héritiers seront redevables des droits de succession sur leur part d’héritage. Les droits de succession sont un impôt indirect dont le taux dépend du degré de parenté entre le défunt et l’héritier. La base imposable est divisée en tranches, dont les plus élevées sont taxées plus lourdement par rapport aux tranches plus basses.
Les Régions sont compétentes, depuis 1989, pour changer les taux d’impositions et les exonérations en matière des droits de succession. La taxation diffère donc selon le lieu où la succession s’ouvre et qui peut se trouver dans la Région flamande, la Région wallonne ou la Région de Bruxelles Capitale.
Les personnes qui héritent du défunt peuvent être désignées par testament. A défaut de testament, les héritiers seront indiqués par la loi. L’époux, les descendants, les parents, les frères et sœurs, les grands-parents et les autres proches du défunt, limité au quatrième degré, appartiennent au groupe des héritiers légaux.
L’époux et les descendants passent avant les parents, frères et sœurs, qui ont, à leur tour, la priorité sur les grands-parents, etc. Au sein de ces « ordres », le plus proche en degré de parenté a la priorité sur ceux qui sont parents de degré ultérieur.
Lorsqu’une personne décède, laissant plusieurs enfants dont un est déjà prédécédé, les enfants de cet enfant prédécédé pourront prendre la place de leur parent par représentation successorale.
Ceci se pose toutefois la question des conséquences de cette technique successorale sur le plan des droits de succession, qui diffèrent, quant au taux, en Région flamande, entre époux et descendants (3, 9, 27%), entre frères et sœurs (30, 55 et 65%) et entre toutes autres personnes (45, 55, 65%).
