Commissions secrètes: une première brèche dans un système inique

Dans son numéro de mars 2000, IDEFISC se référait à un arrêt de la Cour d'appel de Liège qui, à la demande d'une congrégation religieuse, décidait de poser une question préjudicielle à la Cour d'arbitrage relative à la compatibilité de la cotisation spéciale de 300 % sur les commissions secrètes prévues à l'article 219 du Code des Impôts sur les Revenus avec les article 10 et 11 de la Constitution. La Cour d'arbitrage a statué sur cette question préjudicielle dans un arrêt du 6 avril 2000.
La Cour d'arbitrage a consulté les travaux parlementaires relatifs à l'article 219 du CIR dont il ressort que le législateur entendait combattre certaines formes d'abus et a établi une corrélation entre d'une part la déductibilité des montants de commission secrètes dans le chef de celui qui les paie et d'autre part, l'imposabilité de ces montants au nom des bénéficiaires.
La Cour considère que la lutte contre les fraudes, en décourageant la pratique des commissions secrètes, justifie une sanction fiscale dans le chef des contribuables qui commettent ces fraudes. Toutefois, la Cour indique qu'il convient que les mesures prises n'aillent pas au-delà de ce qui est nécessaire à cette fin.
La Cour a examiné s'il était disproportionné d'appliquer cette mesure à des contribuables qui n'ont pas eu l'intention de soustraire une matière imposable à l'administration et dont la négligence n'a pas effectivement empêché celle-ci de procéder à la taxation des revenus dans le chef des bénéficiaires.
La Cour considère que la sanction de l'article 219 du CIR est lourde mais que ses effets sont atténués par la faculté qu'ont les contribuables assujettis de déduire le montant payé à titre de cotisations...
