Une avancée concernant les revenus mobiliers encaissés à l’étranger

La Cour de justice des Communautés européennes a rendu ce 1er juillet une décision importante en matière de fiscalité des revenus mobiliers encaissés à l’étranger.
Comme on le sait, le régime fiscal des revenus mobiliers perçus par des personnes physiques se caractérise, en Belgique, par le système du précompte libératoire : les contribuables soumis à l’impôt des personnes physiques ne sont pas tenus de mentionner, dans leur déclaration annuelle, les revenus mobiliers pour lesquels le précompte mobilier a été acquitté, ce qui est le cas de tous les revenus mobiliers encaissés auprès d’un intermédiaire établi en Belgique.
Pour ces revenus, l’impôt se limite donc au précompte.
Il en va toutefois autrement pour les revenus mobiliers encaissés à l’étranger, qui ne peuvent pas bénéficier de ce précompte libératoire : ces revenus doivent être mentionnés dans la déclaration annuelle, et ils sont imposables au titre de revenus mobiliers. Le taux de l’impôt est certes identique au taux du précompte (15 ou 25 % selon le type de revenus), mais cet impôt sert ensuite de base de calcul à la taxe communale additionnelle, qui varie, selon les communes du Royaume, de 0 à … 8 ou 9 %.
Il en résulte une discrimination manifeste : la personne physique qui perçoit des revenus mobiliers dont le débiteur est établi à l’étranger voit son régime d’imposition différer selon qu’il décide d’encaisser ces revenus auprès d’un intermédiaire établi en Belgique, ou au contraire directement auprès du débiteur établi à l’étranger. Dans le premier cas, il subit un impôt égal au seul précompte ; dans le second cas, il subit en outre la taxe communale additionnelle sur cet impôt.
Deux contribuables anversois, bénéficiant de revenus mobiliers perçus aux Pays-Bas, ont contesté la taxe communale additionnelle de 8 % qui leur a été appliqué sur l’impôt acquitté en Belgique par suite de la déclaration de ces revenus étrangers.
