17 JULI 2002. - Decreet betreffende de regelmatige inschrijving van leerlingen in het gewoon basisonderwijs en tot wijziging van het decreet van 13 juli 1998 tot organisatie van het gewoon kleuter- en lager onderwijs en tot wijziging van de onderwijswetgeving (1)
De Raad van de Franse Gemeenschap heeft aangenomen en Wij, Regering, bekrachtigen wat volgt :
Artikel 1. In artikel 2 van het decreet van 13 juli 1998 tot organisatie van het gewoon kleuter- en lager onderwijs en tot wijziging van de onderwijswetgeving worden de volgende wijzigingen aangebracht :
« 30° Regelmatig ingeschreven leerling : diegene die is ingeschreven overeenkomstig de regels inzake de schoolplicht, bepaald door artikel 1 van de wet van 29 juni 1983 betreffende de schoolplicht en de regels inzake de regelmatige inschrijving van de leerlingen die vermeld staan in onder meer artikelen 76 en volgende van het decreet van 24 juli 1997 dat de prioritaire taken bepaalt van het basisonderwijs en van het secundair onderwijs en de structuren organiseert die het mogelijk maken ze uit te voeren;
31° Regelmatig schoolbezoek : het feit om regelmatig alle lessen bij te wonen - van de eerste tot de laatste schooldag -, waarbij elke afwezigheid behoorlijk gewettigd wordt, overeenkomstig artikel 32, vierde lid, van het decreet van 30 juni 1998 dat erop gericht is alle leerlingen gelijke kansen op sociale emancipatie te geven, inzonderheid door de invoering van maatregelen voor positieve discriminatie.
Art. 2. Artikel 26, eerste lid, van hetzelfde decreet, wordt vervangen door het volgend lid :
Het lestijdenpakket dat geldt van 1 september tot het eind van het schooljaar wordt berekend op basis van het aantal regelmatige leerlingen in de school ingeschreven op 15 januari jongstleden en die regelmatig de school bezoeken, op voorwaarde dat deze school of vestigingsplaats op 1 oktober van het lopende schooljaar behouden blijft, indien ze het onderwerp van een afzonderlijke telling vormde. Worden evenwel in aanmerking genomen, alsof ze de school regelmatig bezocht hadden, de leerlingen die ongewettigd afwezig waren, op voorwaarde dat de in artikel 10, eerste lid, van de gecoördineerde wetten van 20 augustus 1957 op het lager onderwijs...
