La loi-programme du 27 décembre 2005 permet au contribuable de réparer le manquement consistant à ne pas avoir déclaré tous ses revenus.
Il s’agit en fait exclusivement de recréer la possibilité, qui existait jusqu’au 1er janvier 2004 en vertu de dispositions purement administratives, de déclarer spontanément à l’administration des revenus omis dans des déclarations précédentes. Avant l’entrée en vigueur de la DLU, il était en effet possible pour un contribuable n’ayant fait l’objet d’aucun contrôle ou d’aucune annonce de contrôle, de déclarer spontanément des revenus antérieurement omis, et de payer exclusivement l’impôt éludé, sans aucune pénalité.
Cette possibilité avait été supprimée du commentaire administratif avec l’entrée en vigueur de la Déclaration Libératoire Unique. Il n’empêche que, dans la pratique, on conçoit difficilement d’empêcher les contribuables de venir déclarer eux-mêmes à l’administration qu’ils ont négligé, volontairement ou non, de déclarer précédemment des revenus. La seule question qui se posait était celle de savoir si l’administration allait ou non appliquer des majorations à titre de sanction dans ce cas. En l’absence de position officielle de l’administration, ces questions se négociaient au cas par cas.
La loi revient purement et simplement à rétablir, pour une période limitée, la règle antérieure permettant de déclarer, sans risque de pénalité administrative, des revenus omis précédemment.
Ce n’est donc en rien une révolution, ni même un progrès par rapport à la situation qui prévalait avant la Déclaration Libératoire Unique.
Cette possibilité est ouverte tant pour les personnes physiques que pour les sociétés. Cette mesure ne concerne pas exclusivement l’impôt sur les revenus, mais également la TVA.
