Une nouvelle rubrique263 a été ajoutée à l'A.R. n° 20 relatif au taux de T.V.A.264, depuis lors déjà modifiée avec effet rétroactif au 1/1/2007265. Elle concerne les démolitions avec reconstructions de bâtiments.
Le taux réduit de 6% peut être appliqué aux conditions suivantes :
Les opérations doivent être relatives à un bâtiment d'habitation qui, après l'exécution des travaux, est utilisé, soit exclusivement, soit à titre principal comme logement privé, que la reconstruction concerne une maison unifamiliale ou un immeuble à appartements.
Le texte ne précise pas ce que l’Administration entend par «à titre principal».
Le texte en vigueur jusqu’au 31/12/2008 stipulait que les habitations démolies et reconstruites devaient être situés sur certains territoires bien définis :

Les opérations doivent concerner un bâtiment d'habitation situé dans une des grandes villes énumérées dans les A.R. du 12/8/2000, du 26/9/2001 et du 28/4/2005 en exécution de l'article 3 de la loi du 17/7/2000 déterminant les conditions auxquelles les autorités locales peuvent bénéficier d'une aide financière de l'Etat dans le cadre de la politique urbaine.
Les opérations doivent concerner une habitation située sur le territoire de l'une des 32 villes suivantes :
• les centres urbains d'Anvers, Charleroi, Gand, Ostende, Malines, Mons, La Louvière, Saint-Nicolas, Seraing et Liège;
• sur le territoire de la Région de Bruxelles-Capitale : Bruxelles, Anderlecht, Saint-Gilles, Saint-Josse-ten-Noode, Molenbeek-Saint-Jean, Schaerbeek et Forest;
• Louvain, Bruges, Courtrai, Roeselare, Alost, Termonde, Genk, Hasselt, Mouscron, Tournai, Verviers, Namur, Ixelles, Uccle et Etterbeek.
Une autorisation préalable de l'autorité communale de laquelle il ressort que le bâtiment est situé dans une zone urbaine, n'est pas exigée.
Cette obligation de localisation a disparu du moins pour la période du 1/1/2009 au 31/12/2009 :

Les opérations doivent concerner un bâtiment d'habitation situé sur n’importe quel territoire.
Les opérations doivent être fournies et facturées par une personne qui, au moment de la conclusion du contrat d'entreprise, est enregistrée comme un entrepreneur indépendant.
