Les recours introduits devant les cours, les tribunaux et les autres instances à partir du 1er janvier 1999 le seront suivant les dispositions en matière de procédure telles qu'elles sont modifiées par la loi du 15 mars 1999. les procédures pendantes au 31 décembre 1998 seront toutefois poursuivies et clôturées conformément aux règles en vigueur à cette date.
La solution des difficultés qui peuvent s'élever relativement à la perception ou au recouvrement (c'est nouveau; loi du 25 avril 2007 portant des dispositions diverses - IV) des droits de succession et de mutation par décès avant l'introduction des instances appartient au Ministre des finances ou au fonctionnaire délégué par lui (c'est nouveau).
Si après échanges de vues, le désaccord avec le ministre ou le fonctionnaire délégué par lui persiste sur une difficulté visée à l'alinéa 1er, le contribuable peut introduire une demande de conciliation auprès du service de conciliation fiscale visé à l'article 116 de la loi du 25 avril 2007 portant des dispositions diverses (IV).
Dans le cas où la difficulté concerne la valeur vénale d'un bien qui est soumis à l'expertise visée à l'article 111, la conciliation du service de conciliation fiscale ne peut plus être demandée ou se poursuivre à ce sujet dès lors que la demande d'expertise de contrôle est notifiée.
Le Roi peut déterminer les difficultés relatives à la perception et au recouvrement des droits de succession pour lesquelles la conciliation du service de conciliation fiscale est exclue (c'est nouveau). Page 254
Le ministre des Finances ou le fonctionnaire délégué par lui (c'est nouveau) conclut les transactions avec les contribuables, pourvu qu'elles n'impliquent pas exemption ou modération d'impôt.
Dans les limites prévues par la loi, le montant des amendes fiscales proportionnelles prévues par le présent code ou par les arrêtés pris pour son exécution, est fixé selon une échelle dont les graduations sont déterminées par le Roi (article 141).
