En vertu de l'article 17, alinéa 3, du décret du 11 mars 1999 relatif au permis d'environnement, le dossier d'évaluation des incidences sur l'environnement doit faire partie du dossier de demande de permis d'environnement. Concrètement, cela signifie pour le demandeur qu'il doit se plier à la procédure d'évaluation des incidences avant de pouvoir introduire une demande de permis d'environnement.
Attention !
Nous insistons ici sur le fait que l'exigence d'évaluer les incidences du projet s'applique à toute demande de permis d'environnement. Elle prend néanmoins dans la majorité des cas la forme simplifiée d'une «notice d'évaluation»328.
L'évaluation des incidences du projet joue un rôle préventif. En imposant l'analyse des effets du projet à un stade aussi précoce, le législateur entend notamment permettre au demandeur de modifier son projet et même d'envisager des solutions alternatives en fonction des résultats de l'évaluation.

Si le demandeur omet de réaliser l'évaluation des incidences de son projet avant d'introduire sa demande, cette dernière sera déclarée incomplète par le fonctionnaire technique...
