Une nouvelle menace pour le secret professionnel des comptables

L’article 458 du Code pénal punit d’un emprisonnement de huit jours à six mois et d'une amende déterminée, les personnes dépositaires, par état ou par profession, des secrets qu'on leur confie et qui les auront révélés. Des exceptions existent dans le cas où ces personnes sont appelées à rendre témoignage en justice ou devant une commission d'enquête parlementaire et celui où la loi les oblige à faire connaître ces secrets.
Les experts-comptables externes, conseils fiscaux externes, comptables agréés externes, comptables-fiscalistes agréés externes et réviseurs d’entreprise font partie des personnes tenues au secret professionnel.
Ils ne peuvent donc, en principe, rien révéler de ce qu’ils ont appris dans le cadre de leur profession et cela constitue une protection importante pour leurs clients.
Une nouvelle loi va néanmoins changer la situation en ce qui concerne ces professionnels du chiffre. En effet, le projet de loi du 12 mars 2013 modifiant diverses législations en matière de continuité d’entreprises a été adopté à la Chambre et n’a pas été évoqué par le Sénat. Le projet de loi a été sanctionné et promulgué le 27 mai 2013. Il ne devrait donc pas tarder à être publié au Moniteur belge.
Ce texte impose de nouvelles obligations aux professions comptables et les encourage à dévoiler des informations normalement couvertes par le secret professionnel.
Ainsi, la nouvelle loi imposera à l’expert-comptable externe, le conseil fiscal externe, le comptable agréé externe, le comptable-fiscaliste agréé externe et le réviseur d’entreprise qui constatent dans l’exercice de leur mission des faits graves et concordants susceptibles de compromettre la continuité de l’entreprise du débiteur d’en informer de manière circonstanciée le débiteur. Jusque là, le texte ne pose a priori pas de problème.
