Les travaux de démolition d'immeubles sont considérés comme des travaux immobiliers. Ils suivent également les règles de report de perception, de facturation et de taux.
Par contre, la valeur normale ainsi que la base minimale imposable ne leur est pas applicable puisque ces travaux ne portent pas sur des bâtiments à ériger.
Il s’agit de la convention par laquelle une personne (l'entrepreneur) s'engage à démolir une construction et à enlever des immondices, déchets, débris, etc. pour le compte d'un cocontractant (le maître de l'ouvrage) qui lui cède la propriété des matières enlevées ou des matériaux provenant de la démolition.
L'entrepreneur effectue une prestation de services soumise à la T.V.A. si toutes les conditions d'exigibilité sont réunies.
Le maître de l'ouvrage effectue une livraison de biens soumise à la T.V.A. (s’il est assujetti avec droit à déduction), sans T.V.A. s’il ne l’est pas.
Lorsque l’opération est soumise à la T.V.A., le taux applicable dépend de la nature des matières ou des matériaux cédés.
Il y a lieu de faire les distinctions suivantes :
Entrepreneur réclamant une somme d'argent
Pour la prestation de services effectuée par l'entrepreneur, la T.V.A. devrait, en principe, être perçue sur la somme payée en argent par le maître de l'ouvrage, augmentée de la valeur normale des matières ou des matériaux cédés.
Etant donné qu'il s'agit, la plupart du temps, de biens dont la possession est onéreuse pour le maître de l'ouvrage, l'Administration admet que la valeur des matériaux soit négligée et que la perception s'effectue uniquement sur le prix en argent.

Dans le même ordre d'idées, aucune T.V.A. ne doit être perçue sur la cession de déchets ou de matériaux provenant de la démolition.
Cette tolérance ne vaut cependant pas lorsqu'il ressort clairement de la convention conclue entre les parties, que ceux-ci ont reconnu une valeur importante aux matières ou aux matériaux ou, en d'autres termes, lorsque la somme payée est manifestement inférieure au prix de revient normal du travail effectué par l'entrepreneur.
Entrepreneur ne réclamant pas de somme d'argent
Dans ce cas, il est certain qu'une valeur est reconnue aux matières et matériaux.
