Il revient à celui qui dénonce les lacunes du dossier de rendre vraisemblable que ces défauts ont empêché l'administration d'appréhender convenablement la demande et qu'en leur absence, elle aurait pu être amenée à prendre une décision différente.
Les règles de droit civil ne constituent pas des règles de police d'aménagement du territoire au regard desquelles la légalité d'une demande de permis doit être examinée.
