2 JUNI 2023. - Besluit van de Vlaamse Regering tot aanwijzing van een bevoegde instantie als vermeld in artikel 3 van verordening (EU) nr. 598/2014 van het Europees Parlement en de Raad van 16 april 2014 inzake de vaststelling van regels en procedures voor de invoering van geluidsgerelateerde exploitatiebeperkingen op luchthavens in de Unie binnen het kader van een evenwichtige aanpak, en tot intrekking van Richtlijn 2002/30/EG
Rechtsgrond
Dit besluit is gebaseerd op:
- de wet van 18 juli 1973 betreffende de bestrijding van de geluidshinder, artikel 1, gewijzigd bij de wet van 21 december 1998 en het decreet van 26 april 2019.
Vormvereiste
De volgende vormvereiste is vervuld:
- De Inspectie van Financiën heeft advies gegeven op 22 mei 2023.
Initiatiefnemer
Dit besluit wordt voorgesteld door de Vlaamse minister van Justitie en Handhaving, Omgeving, Energie en Toerisme.

DE VLAAMSE REGERING BESLUIT:
Artikel 1. Dit besluit voorziet in de gedeeltelijke uitvoering van verordening (EU) nr. 598/2014 van het Europees Parlement en de Raad van 16 april 2014 inzake de vaststelling van regels en procedures voor de invoering van geluidsgerelateerde exploitatiebeperkingen op luchthavens in de Unie binnen het kader van een evenwichtige aanpak, en tot intrekking van Richtlijn 2002/30/EG.
Art. 2. Het Departement Omgeving wordt voor de luchthaven Brussel-Nationaal aangewezen als bevoegde instantie als vermeld in artikel 3 van verordening (EU) nr. 598/2014 van het Europees Parlement en de Raad van 16 april 2014 inzake de vaststelling van regels en procedures voor de invoering van geluidsgerelateerde exploitatiebeperkingen op luchthavens in de Unie binnen het kader van een evenwichtige aanpak, en tot intrekking van Richtlijn 2002/30/EG.
